Terms & Conditions


Acceptance of Terms



We accept clients from all around the world, so long as the final product is in English and payment arrangements are agreed upon. Depending on the staff's linguistic skills, additional languages may be requested. The customer ("you", "the user") has hired Mobi9Tech ("Us", "Service provider", "We", or "the site") to supply web-based services as specified in the client's job description.


By using the site, you agree to be bound by these terms and conditions, and your agreement with us on the terms of service becomes effective as soon as you begin using this website and our services.



Our typical weekdays are Monday through Friday (check Office Hours & Communication for further information). The client will receive information, finished projects, updates, milestones, etc. via email or another way as agreed upon. All files are scanned for viruses prior to delivery. There is no fee for email delivery. Alternative delivery options (courier, etc.) will incur additional fees.


The service may be terminated at any moment after the billing cycle has concluded. Alternate arrangements can be done between parties.

Expenses

Costs incurred on Client's behalf are not included in the fees and will be paid to Client separately. Expenses that may be reimbursed include, but are not limited to, mileage, long-distance telephone charges, vendor payments, and shipping and handling fees. Long-distance phone calls will be made only when absolutely necessary and will be invoiced at cost if they are not included in the client's service plan. Meeting time, round-trip travel time, and mileage will be billed for on-site visits. An upfront expense deposit may be asked. Payment is payable upon receipt.

Responsibilities

Client acknowledges that Service Provider is not an employee and that this will be a collaborative, professional partnership between equals in which professional respect, civility, and consideration are expected. Owing to the virtual nature of the relationship, the Client appreciates the necessity of communication, particularly via email, and agrees to promptly respond to Service Provider's inquiries, requests, and communications. The client is aware that Service Provider is a company with other clients to service and requires a reasonable amount of notice to accommodate requests and initiatives. The Client's poor preparation or miscommunication will not constitute an emergency for Service Provider. Client acknowledges that Service Provider may require detailed clarification of projects to fulfill expectations and give the best assistance and highest quality work, for which the service provider will maintain as many communication channels as possible.

Office Hours and Correspondence

Monday through Friday, 9 a.m. to 6 p.m. (EST), unless otherwise negotiated with the Service Provider. Customer and Service Provider mostly communicate through electronic mail, telephone, and instant messaging. Service Provider is only available for telephone calls during normal business hours. Meetings and appointments (whether in-person, remotely, or over the phone) may need to be booked in advance.

Accuracy

Client agrees that the accuracy of information provided to Service Provider is solely Client's responsibility, and that Service Provider is not responsible and shall not be held liable for the results of services performed based on inaccurate, incomplete, or untruthful information supplied by Client. Customer bears complete responsibility for acceptance of agreed-upon work or services, as well as final proofreading and accuracy. The Service Provider is not responsible for the Client's errors or omissions.

Payment Options

Our services are entirely pre-paid. In addition to credit and debit cards, QuickBooks ACH payments are allowed. Additional payment terms are negotiable with the service provider.

Confidentiality

Our Service Agreement contains a Confidentiality Clause, which must be properly completed prior to the start of work. Mobi9Tech will never, either directly or indirectly, utilize customer information for its own personal gain, reveal such information, or transmit it in any way. Your personal information will be handled in absolute confidence. This provision shall continue in effect long after all agreements and projects have expired. Mobi9Tech will return all documentation, records, and other items utilized or created by Mobi9Tech for its clients throughout the course of our agreement, upon termination of the agreement. Each party shall keep confidential and not disclose to any third party, without the prior written consent of the disclosing party, any information of a confidential nature received from the disclosing party that relates to that party's business (the "Confidential Information"), regardless of whether such information is marked confidential. "Confidential Information" refers to all information, whether in written, oral, or electronic format, and whether disclosed directly or indirectly, that you have designated as confidential and that pertains to the business, affairs, customers, products, developments, operations, processes, pricing, networks, trade secrets, design rights, know-how, and personnel of your company or an affiliated company, if applicable.

Your Privacy

Mobi9Tech will treat any information you provide with the utmost care and will not use it in ways that you have not approved to. Mobi9Tech will seek your consent before collecting personally identifying or contact information. This information is typically requested when you request information or hire our services.

Copyright and Trademark Information

All site content, including site design, text, graphics, interfaces, and the selection and arrangement thereof, is the intellectual property of Mobi9Tech, with all rights reserved, or the property of Mobi9Tech and/or third parties protected by intellectual property rights. Without the prior written consent of an authorized official of Mobi9Tech, any use of the website's content, including reproduction for purposes other than those listed above, modification, distribution, or replication, or any type of data extraction or data mining, is strictly prohibited. Members agree not to use any robot, spider, or other automatic device or manual process to monitor or copy our Web pages or the content included within without the express written authorization of an authorized Mobi9Tech officer. The trademarks of Mobi9Tech may not be used in connection with any product or service that is not offered by Mobi9Tech, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Mobi9Tech.

Non-solicit Clause

In accordance with the applicable laws, you agree that during your membership and for a period of 24 (twenty-four) months following the termination of my relationship with the company, you will not directly or indirectly solicit any of the company's employees to leave their employment at the company and/or hire any employee who has provided services to Mobi9Tech. This situation will result in a fine of $50,000 USD. We do not provide full or partial refunds for purchased subscriptions, regardless of the reason for the refund request.

Cancellation

You may terminate your membership at any time by sending an email requesting cancellation to info@mobi9tech.com. Your cancellation request sent to info@mobi9tech.com will be regarded as received one (1) business day after We receive it. Your subscription will be terminated at the end of the billing cycle in which your cancellation request is received. For instance, if you acquire a subscription on January 1 and decide to cancel it on January 15, your subscription will be canceled as of 11:59 p.m. Eastern Time on January 15. If your subscription has a monthly charge payment structure, the portion of the monthly fee corresponding to January 16-31 will not be returned. All sales are final. We do not provide full or partial refunds for purchased items or subscriptions, regardless of the reason for the refund request.
